I think he counts as a criminal. He's planning ahead, I believe there will be more of him.

But if not him then it's probably Lester. Zero from GTA San Andreas was also very smart. (if you remember what he was doing aside the RC stuff.)

I doubt it was his empire tbh, tenpenny was only associated with it. He was just really great at being a dick and wiping out witnesses.
