Making a Murderer [Netflix Documentary]

Second season is out for those interested. Watched, or rather fast-forwarded through it today. The only parts that were interesting to me were about the improper compulsion that lead to Dassy's confession. His post-conviction legal team actually made arguments that had legal merit, and offered a fascinating look into habeas proceedings. The same can't be said about the new counsel for SA, however, employing a mix of spurious forensic theatrics, junk science, unsubstantiated inferences and bizarre impugning of other's as potential suspects that may or may not have risen to defamation - to somehow get his conviction overturned? Disappointing to say the least. 

 

Wouldn't really recommend it unless you skip to the parts about BD and how his case made its way through the state and fed courts.

I remember being glued to this when it was first released and then after listening to Serial podcast. These cases are really interesting and it's been so long now that I don't even remember what I originally thought about their cases and questionable guilt - although thinking back, I think I was on the fence.  I'm really conscious of people wanting the underdog to win or it being kind of more "sexy" to if it was an innocent man/men jailed for crimes they didn't commit and the social justice hysteria these campaigns can bring - a rightly so. If anyone has ever seen the Paradise Lost series about the West Memphis Three, you definitely can and will think the justice system may have got it wrong. But I'm unsure about this.. 

 

For those of you interested in Making A Murderer type shows and haven't seen Paradise Lost, it's exceptional and very harrowing. It's about the imprisonment and public witch hunt against 3 teenagers for the murder 3 young buys that were found mutilated and killed. They were basically targeted by law enforcement because they listened to metal music and were thought to have commited some satanic ritual against the kids. One of the kids was pressured in to a confession. He had learning difficulties/low IQ if I remember correctly. Anyway, theres this doc and about 2 more up to the conclusion.. very compelling. 

 

The trailer isn't that great but it's produced by HBO who had exclusive access to the trial at the time (to which the judge regrets ever giving permission for). It's been distrubted by Warp label in UK (that will mean something to some of you ;) )

I remember watching all three of them when they came out and couldn't believe how bad they those were railroaded for some reason I always have and still feel that Byers had something to do with it with the way he acted and how he purposely forced them to not be able to give him a lie detector test and then all the sudden is now on the side of the boys and supporting them.

 

It's a good watch but I will warn those with a weak stomach that in the first view minutes of the opening and during the trial it's very graphic and shows actual crime scene footage/photos of the three young boys naked and dead.

 

If you don't have HBO but do have Amazon Prime it's can be watched on Amazon Prime right now.

Sidenote: Don't take what you see in MaM as fact, as someone who knows a thing or two about law - most of it is really stupid and incredibly one-sided. I do agree with you on the rubbish blood spatter analysis, that part almost made me cringe, however you can't deny that there are so many inconsistencies within the whole case... I still think Steven was framed, the guy ain't a killer(like he wasn't a rapist, but spent 18 years in prison for something he didn't do). That already shows the incompetence of the US justice system.

 

Luckily the DNA test came to his rescue. I mean the whole Manitowoc County hates the guy, its obvious to see. Now what's happening is that the higher courts don't want to admit the failure of the lower courts therefor denying him and Brendan for retrial, that's how I basically see it.

 

I'm 100% sure he didn't murder her, nor did Brendan Dassey, that confession is absolutely f****d up!

If you go by the MaM documentary, then sure - it is incredibly one-sided and makes him look like a choirboy. In reality, MaM omits a lot of inculpatory evidence, which are far more damning than the the supposed inconsistencies which are both misrepresented and blown out of proportion. Not least of which SA's prior history and previous sexual allegations, and violent tendencies in the past. Not to mention his purchasing handcuffs and shackles shortly before the murder, as well as witness testimony of him disposing of Halbach's possessions in a burn barrel.  Also the problem with a "frame" theory is that both the entirety of the police department and prosecutor's office and the actual perpetrator simultaneously but independently had to frame SA. Which is a bit ridiculous. I'm convinced beyond a reasonable doubt that he did in fact assault, murder and disposed of her remains. Which is the standard required for conviction.
