It should be based solely on factual evidence regarding what works as far as crime prevention and reintegration into society is concerned. Opening it to the whims of hysterical and emotionally biased individuals is simply barbaric. Retributive justice is every bit as bad as the violence it's supposed to be a response to. It serves no purpose other than pandering to a small number of victims to the detriment of wider society. The death penality is simply ridding society of these dangerous/violent individuals who don't care or respect humans rights or their feelings to begin with. How is the death penality by itself barbaric? Some of you keep saying this. Basically it's barbaric because it involves the killing of other human beings. Murder in any form is barbaric, and for our government, of for and by the people, to be participating in this is just a dirty thing.I've always had The belief that justice is entirely worthless anyway. What is justice? Justice is basically revenge. I realize I contradict myself from my first post, but admittedly i wasn't looking for an argument and wanted to appeal people who are pro-death penalty by using their own logic to provide a better solution. People should go to prison only so they can be removed from society and avoid hurting other people, punishing them will never bring anyone back, or change anything, but it will take them out of society and prevent harm to others. But that's not really good enough in my eyes, people who commit heinous crimes are twisted in the head (accOrding to our standards, let's not get too philosophical though), they need rehabilitation, and once they are they can be released back into society and not harm other humans. No this isn't fool proof, but it's a lot better than sending someone to prison to become a more hateful, cynical being who will harm others in and out of prison, and for those justice seekers, I'm sure once the person does start getting rehabilitated he will feel terrible remorse.
