Of course you can get banned for modding your console. It's against T&C.

Yes, R* will permaban your console from GTA:O, and Sony will permaban your console from the PSN, which means no more online play!

Rockstar does not want any modders in their online component, and it breaks the terms and conditions of your console manufacturer (Microsoft or Sony). So yes, you can get banned for it.
