This is how Rockstar gets around not having to pay for licensing of vehicle likeness. They take a model of say a Ferrari and alter it a bit, or combine it with styling from a different car (just like the Gauntlet being about 50% Camaro and 50% Challenger). Many companies do this to circumvent copyright. Also, in any of the fine print it says that any likeness of people or situations to that of real ones is purely coincidental, for the sole purpose of preventing things like this. I wouldn't call it a "cop out" by Rockstar since they never said anything. This is a case where the model came out and made it known it was her, after a lot of people was confusing her with photos of pornstar Alexis Texas(I think the confusion started on reddit). Also the cover photo pose to is pretty common, a blonde girl taking a selfie with a beach foreground... it's been done and seen hundreds of times before. If Shelby Welinder never confirmed it was her I would've thought the cover girl was iJustine, Candice Swanepoel or countless other models since they all resemble the cover art. So if anything, Kate Upton has a case, just like that of the Barack Photographer for the OBEY artwork. Lindsey won't get anything from Rockstar as their small print before the game loads suggests that any resemblemce to real life counterparts within GTA V are purely coincidental. Some of them obviously aren't a coincidence, but that is there in writing to cover Rockstars asses when stuff like this happens. There is no way she will get anything. That musician who wanted money from Rockstar for using his songs without permission ad a better case, and look what that got him when battling Rockstar, nothing.
