Will one be the only star where police will not fire at you? As well as when, how seems to be a very interesting and still developing question. The helicopter marksmen seem to be on top of their game; rifles with a laser attachment. But, in multiple screenshots, a sheriff SUV can be seen with SWAT members hanging from the sides. If the SUV could keep up with the protagonists, the chase could prove to be much more difficult than, say, a single officer with a handgun firing from the passenger side, like in IV. I'd assume it's something like this: 1 star- anything short of killing someone. police chase you on foot. 2 star- killing someone or attacking a policeman. Police shoot you and chase you by car. 3 star- killing more than one person. Chopper comes in. 4 star- continuing the rampage. SWAT comes in with better weapons and vehicles. 5 star- similar progression to 4 stars. Possible armed forces or at least armoured vehicles. If your gun is hidden, they'll probably try to arrest you, even if you're at 5-6 stars. I'm just guessing though, but I think it would add more gameplay possibilities if AI can tell when you're walking around with your gun out or not.
