Legal or illegal, the crimes Niko committed in Liberty City are even worse than being any illegal immigrant. We don't know exactly how and why Roman came to Liberty City. Because Niko came later, this might mean he actually took the time for the whole immigration process to carry out. True, I'm not sure about roman lol but we know for a fact Bernie is illegal. No, and this often doesn't happen in real life either, because immigration is exclusively federal jurisdiction and not under local police and frequently an undocumented person cannot be matched to a database confirming his status, especially if the person gives false information. In any case Niko would not be deported until after he was prosecuted for the crime he was arrested for, and this never happens because, like all GTA protagonists, he can bribe his way out of custody every time.
