I was doing construction work all day and I just got home at around 5:30. When I got there My assistant manager and two other employees were just slouching around and not doing anything because it was extremely slow. My manager said she couldn't give me my check because it was dinner time and you can only get you check from 10-11, 2-5, and after 8. So I left. Is this legal? Anyway i would think you should be able to get your cheque at anytime, but if they are the company rules then just go back tommorow at one of those times. If they just make this up as they go along, then yes, unless you/lawyer investigate further and find out it is not. BTW: That means if it's not included in their policy in any shape/form, then it's illegal. If it's implied in some other way, then it may not be. Hence why there are lawyers. They are meant to exploit those areas where the law can be unclear. We may hate them in most cases, but they are great in the right circumstance because they are trained to read the literal definition and find where the literal definition does not apply to you. Your check is to be made available to you on the day you get paid as per the agreement with your employer. This is why a lot of companies get their checks on Thursdays when payday is Friday, so in case something happens and the delivery is late they will still get it on payday. I believe the only leverage they have is a "start of business day" thing where they can say "we don't open until 8 so you can't get your check until then" type of thing. Sounds to me like a manager on a power trip. I'd call up your District Manager and let them know what's going on. I've almost always had direct deposit (thank f*ck), but if I didn't have my money on pay day I'd be flipping. I started working in 1996, and I have never been handed a cheque as payment. Ever. Well some people freelance their trade, so the only way for them to get paid is either a physical check or online money transfer, and I sure as sh*t prefer the less complicated method of getting a check written out. Actually Cheque is the British way of spelling it, as well as the Canadian way. I think that since check can mean more than one thing in a sentence, the better way to spell it is Cheque...either way is right though I guess. So she hands this memo to the cougar interviewing me. Victim looks at it and throws it away as the other old crow exits. Then said victim starts bitching about how they are being ordered to do menial jobs as their work load keeps increasing after being forced into a 20% pay decrease. She throws the memo into her circular file. I stand up and shake her wrinkly old hand, shocked at how her bulging veins pulse with each shake, the urge to shield my face fading as she endures my enthusiasm.
