Seachmall
Either way, electronics have a warranty. No reason to not let him get a new phone. But if a store has an explicit "no returns/refunds" policiy then the terms of the warranty must be met by the manufacturer which must be done by the customer himself, not via the store. I know that one because I use to have to tell people the same thing when I was working in Currys.digital. While repair warranties are dealt through the manufacturer the store can't simply pawn the customer off on them. If the product is not working he is fully entitled to a refund, something the store is obligated to give. A "no returns/refunds" policy does not impede consumer rights. While I agree with you, that is not the way the market works. A store is allowed to trade under a "no refunds/returns" policy and customers are expected to be aware of this when purchasing goods from their store and sign a silent agreement with the store during the transaction. It's a despicible practice, but it still, sadly, holds up in most trading standards cases.
Seachmall
Not under Irish or British law anyway. Here a "No returns/refunds" policy only refers to goods the consumer no longer wants, if the product is faulty they must give a refund or replacement. If under warranty the consumer can also choose to repair it. When purchasing goods you are entering into a contract, under that contract certain assumptions are made but if the product fails to meet those assumptions the contract is void and you are entitled to a refund. According to the law, the goods must be of a satisfactory quality and be safe, they must be fit for the purpose for which you are buying them and they must be as they are described by the seller, or on the label or sign. Also, the item must not be damaged unless pointed out by the seller at the time you bought the item. - http://www.Connexions-Direct.com Here's a consumer rights page that specifically deals with mobile phones, If you have only had the phone a few weeks or haven’t had a reasonable opportunity to check it, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement. - ConsmerDrect.gov.uk I'd be surprised if it differed in the US. ass reamer
I have no idea what you just said. He may be foreign but that post was completely 100% understandable, dude. Give it a read over. You're forgetting that people love to rail on a person who doesn't speak English as a first language. In that case, it is completely unintelligble. stretch.
CEX is computer exchange isn't it? None of that sh*t has warranty, implied or otherwise. It's a pawn shop for electrical goods.
K^2
If the phone isn't working they're legally obligated to provide him with a repair, replacement or refund. Yes, and the manager was only stating that they don't do refunds. He did not imply that they were not going to attempt to repair or replace it. Prior to filing a bug against any of my code, please consider this response to common concerns.

Yes, and the manager was only stating that they don't do refunds. He did not imply that they were not going to attempt to repair or replace it. Is that not the consumers choice? He may decide he doesn't want to continue doing business with them as a result. They no longer have a contract and he has no obligation to continue doing business with them, he can choose to take the refund, and they must provide it. It's not up to the seller to make the decision forcing the customer to renew a contract with them. Although if, as mentioned above, it's a pawn shop then that's a different story. I'm not sure of the law regarding that.
