Instead, he had to most likely try and be a badass and deal with the situation himself. I think you're leaving a lot of details out. Like did your father use a weapon of some sort? What part of weve done it several times and they dont do anything dont you understand? Plus my dad wanted a picture so he can prove it stupid. Getting evidence and then he got punched. It's corruption that police aren't going to take time out of their day (which is spent going to legitimate calls, and filling out hours of paperwork from said calls), to arrest a man for peeing on a yard? Going beyond a reasonable amount of force (i.e.- what your father did) is grounds for an assault charge. EDIT: Actually, I have my copy of the Canadian Criminal Code handy, which doesn't differ much at all from the US Criminal Code. Self Defence (section 37 of the Canada Criminal Code)is defined as : "Everyone is justified in using force to defend himself or any under his protection from assault, if he uses no more force than necessary to prevent the assault or the repetition of it." It goes on further to say : "Nothing in this section shall be deemed to justify the willful infliction of any hurt or mischief that is excessive, having regard to the nature of the assault that the force used was intended to prevent." You are half right, the other guy, who has several alcahol related arrests and was sentenced to 2 years in prison is a thug. Hell, they've cut me slack before. I was out driving on the backroads with my boyfriend once before I got my drivers license. I wanted to drive, so he let me. First corner we turn, there's a random road block because it was the 4th of July, and there tend to be a lot of drunk drivers around there. Low and behold, the officer found I was driving without a license and just told us to go ahead and switch seats and be on our way. I could have been so screwed over that.
