Very true. Marijuana works well for some depression, but unless you are regularly medicating, I wouldn't recommend it.

Im supposed to go to court on sept 9th. Its 150 miles away. Will I have to pay a fine? cause I can do that. WIll they try and put me on probation? Should I get a public defender. Or just say no contest. The situation was quite hectic.

 

Leavin somehwere had a unopened beer and one open one. I smelt like alcohol but I had not showered and had been drinking for my birthday the previous day. That night I had about a beer and half of another that I had began then stoppedsipping on when I left. They asked me if there was anything in there I said no like a dumbass. Didn't even think. I forgot about the little piece of hash in the glove compartment, all I tought I had was a empty weed container and a pipe. Beer were out o f my mind. I was thinking alot that night. They got me out searched the car and gave me a sobriety test. I passed. Gave my friend tookl responsibility for the beers and when asked who's hash that was I said yes, since it was mine although it was a piece I had given someone who thus stored it in my glovebox. I got a ticket Told us to sober up then drive home later. I was pulled over cause my brake light was out.

I'd try and help, but I'm only familiar with local Florida laws and legal. Out in Cali, it should be a much easier ball game. Here, however, I would definitely get a private attorney.

Alright. For a more exact idea of this, I would need some more information on the ticket(s) since there is sometimes a difference considered for "hash" and just "marijuana". Yes. Hash is considered worse as it is often considered a concentrated form of marijuana.

 

 

For one. What are the legal numbers of the charges against you (ie, the listed misdemeanors on the ticket). It should be listed telling you what they are. Depending on what it is, your options may be slightly different, they may not.

 

 

First, the open can infraction is nothing to worry about. It should just be a ticket and nothing else will show up on your record much. You shouldn't even have to do any driving school or anything either (although, if they give you the option on the papers they send to you, you might consider it for points on your license, insurance rates, etc). An infraction holds no risk of jail time.

 

The misdemeanor is a little more important and where the definition of what was being charged against you comes into effect.

 

For normal procession of under an ounce, you are charged under Health and Safety code 11357 (B). This is for NON-concentrated forms of marijuana. The maximum fine is $100 dollars and NO jail time. It does go on your record though, and there is an exception for punishment if you have previous convictions under the same area in the last two years.

 

For pocession of under an ounce of concentrated marijuana (hash), the fine is up to $500 dollars and/or jail time of up to 1 year in a local jail. This charge falls under Health and Safety code 11357 (A).

 

 

This is what makes the difference. While you can try to use Penal Code 1000 as a defense to avoid conviction by going to a reeducation program of some sorts (and upon completion having your charges dismissed). This only applied for violations under 11357 (B).

 

edit: I also want to add, since I noticed the vehicle part attached to your comment about procession, you could have been charged under violation of Health and Safety Code 11360 (B) which is dedicated to the transportation or "furnishing" of marijuana under 28 grams. Again, I don't believe this requires any jail time, but it does include a fine of up to $100 dollars.

 

edit2: And yes, as far as I know, for the misdemeanor, you will have to show up in court, or hire some attorney to do it for you (this is what is done by some people).

 

 

For the general procession one, I wouldn't think you would need to have an attorney. You can if you'd like, it isn't unusual at times, but I really can't recommend either way for you. That is something you would have to deal with. If you are being charged under subsection A, you may want to consider one though, or at least meet up and talk with someone about it.

 

 

Overall though, it sounds like it isn't so bad. While the procession charge will remain on your record, you are not required to report it to any basic jobs where you have to fill out an application. If they do a background check, they may find it, but I don't believe they are allowed to discriminate solely under that in California (that is what drug screening is for). If you can give me specifics, I can try to research it a little more for you.

I got pulled over 13 f*cking times last night. 13! All for a f*cking headlight that was out in the front. What irks me is that these f*cks can't keep track of sh*t like that. Every time, it was, "Yeah, I'm getting that fixed next week," and then, "Okay, we're letting you off with a warning," couldn't they like make a note: "The Pontiac with this license plate is gonna have his light fixed, stop pulling him over."

 

I don't know what was up with the cops, but they were pulling people over left and right, so I imagine they've got some kind of quota to meet. Probably something to do with all the ads talking about a ramped up effort against drunk driving.

 

 

Anyway, I got scared sh*tless the first time I got pulled over, because I was driving these two people around that I had just met to get some bud. Well, we were waiting, when the dude in the back opens a 40, and I complain about open liquor in the car, and when I get my weed, I decide instead of the lock box, I'll just keep it down this chick's shirt--at least that way constructive posession goes on her. Sounds cold, but whatever, she made the choice. But yeah, I felt like I had jinxed myself when the cop pulled us over. Luckily he didn't even want to search or anything, but if he had found the open liquor, I know he would have searched her, and I would probably have gotten charged with something. Talk about scary.

 

So I get back tonight with some weed, and I want to smoke, so I roll a pretty big joint. Like, a 3 gram joint, smoke half of it, get nothing. So I decide to take out my bubbler to hit some kief, and the f*ckin' thing is broken. I'm waiting for the epoxy to cure as typing this.

ON the ticket exact:

23222(b)vc poss of marijuana in veh (next to it a M is circled for misdemeanor)

 

The piece of hash was very small like my guess is 1/8th of a gram. It was fresh, still wet, didn't have the right smell to it yet either, or it was extremely sh*tty. But nothing abotu hash is written on the ticket.

 

Im gonna call the courthouse and see if I really have to go down there, cause it will be a bitch of a drive.

23222.  (a) No person shall have in his or her possession on his or her person, while driving a motor vehicle upon a highway or on lands, as described in subdivision (b) of Section 23220, any bottle, can, or other receptacle, containing any alcoholic beverage which has been opened, or a seal broken, or the contents of which have been partially removed.

(b) Except as authorized by law, every person who possesses, while driving a motor vehicle upon a highway or on lands, as described in subdivision (b) of Section 23220, not more than one avoirdupois ounce of marijuana, other than concentrated cannabis as defined by Section 11006.5 of the Health and Safety Code, is guilty of a misdemeanor and shall be punished by a fine of not more than one hundred dollars ($100). Notwithstanding any other provision of law, if the person has been previously convicted three or more times of an offense described in this subdivision during the two-year period immediately preceding the date of commission of the violation to be charged, the previous convictions shall also be charged in the accusatory pleading and, if found to be true by the jury upon a jury trial or by the court upon a court trial or if admitted by the person, Sections 1000.1 and 1000.2 of the Penal Code are applicable to the person, and the court shall divert and refer the person for education, treatment, or rehabilitation, without a court hearing or determination or the concurrence of the district attorney, to an appropriate community program which will accept the person. If the person is so diverted and referred, the person is not subject to the fine specified in this subdivision. In any case in which a person is arrested for a violation of this subdivision and does not demand to be taken before a magistrate, the person shall be released by the arresting officer upon presentation of satisfactory evidence of identity and giving his or her written promise to appear in court, as provided in Section 40500, and shall not be subjected to booking.

Yeah I called up the courthouse today. They havent even gotten my paperwork yet. Lady I talked to told me it could be a fine as much as 380 dollars or probation for up to a year. Dear god i hope not, I cant sleep or eat well with out thc, and I dont want to go back to taking meds

No sh*t, I've passed two in the last 6 months. One for my job I quit, and another at the hospital for the job I quit. Passed both with smoking 2 weeks before.
