Copyright Infringement for gameplay video?

i hear ya syphon, all the feeds of IV that were leaked got taken down within 24-48 hours of showing up and becoming popular...its terrible the way rockstar is handling this situation, i can understand removing things that were released early, or things that were made using illegal copies, however if you film something yourself, with no intention of sale or income of any sort, how do they have any right to step in and take it away? corporate america will do that from time to time i suppose  sarcasm.gif  icon13.gif

 

PS anyway, i wouldn't count on take2 or R* suing, chances are VERY slim of that big of a deal from something like that.

They have every single right to. It's a little something called the law. Don't know if you've heard of it or not.

anyway smart ass, think about this, your hosting a live webcam of yourself (for whatever reason) and a copy of GTA IV is sitting in your xbox and its on, so the cam picks it up...is that a copyright infringment? my ass if it is...so how is this different? because its using the title "gta iv"...thats hardly grounds for removal...

@ post above, yeah i used billy sarcastically, anyway, they can do as they please, i suppose its their content in the end....but who gets really screwed? the company because they have gameplay of their game available online? no, but is it the consumer? he loses his right to showcase his gameplay online...so its not really fair either way, lose lose situation i suppose, but they shouldnt make such a big deal out of it!

Think of it in the terms I state above about TV and cable sports casts, they are not intended for rebroadcast without WRITTEN consent of the owners, if R* and Take2 gave you written permission and you had asked, then you'd get away with it scott free, but you'd put yourself up to ridicule and great risk, but to fight for our rights, you could take that challenge on if you wanted to! It's totally your right to follow the guidelines

The game been out for 2 weeks now.

 

I don't understand why it's still not safe for you to upload gameplay...everyone has been doing it.

well however you look at it, its still not fair to the end user...its all about how they enforce it...they allow selected people to release selected material...and DO NOT allow the average joe to tell his ten cents about the game? its just overkill...but regardless...i dont post gameplay videos anyway, being that I dont own a capture card...which makes pretty much the only halfway decent quality vids anyway...

no doubt, i certainly wouldnt go to jail/get probation (ohhh god no drug test plz) or anything like that to entertain others...unless i hosted my own video site...then its sort of "your" material...unless R* saw the site...

 

anyway syphon...you have a video capture card?

It can be something as simple as being elusive. LiveVideo is not monitored very much and you can even upload semi-explicit content (Skinamax type fare!) as an option.. under 17 not allowed kind of option last I used it... However, it doesn't have the draw that GameTrailers or YouTube has and that's how they find it, it's mega popular. Hard to hide something that was not your own. Even if you taped your own copy, there's no way to prove it in the manner it is transmitted... but I am totally in agreement as to why we need the resource, and I'd say again, just be cautious in the way you present your material and comply if they find it.

yeah slamvan, true that, stealth is the only way to truly protect your videos lifetime on the 'net

 

as for where to put it, i would use a simple rapidshare free or megaupload site, then DL the vid to whereever you want to watch it...makes it so its not openly available on the web, and it wont be as "hot", more under the radar of the almighty T2

As I was going to respond, my Wifi Hotspot went cold and never came back, so I had to switch to my tried and true dialup, gotta love it....terminal slow speed that never conks out!

 

Anyway, I think it's bogus as well because there are countless walkthrus and demos from E3, etc... All worthy of show, even people filming others playing Guitar Hero, or what have you.

Google did buy out YouTube, they own it, fully. They have their own video channel and many others do to. You have to keep low profile if you want to have your video 'safe', which is why I'd set up a LiveVideo channel instead of those other two, and I have in fact. Very little hits, but you have to paste the URL in a page to steer people to them. The audio is always in stereo, unlike YouTube and the image is just as good. If you use GameTrailers, they'll also find it and perhaps pull the video off....still

 

Watch what tags you set up, don't make it obvious via tags like GTA 4, gameplay, etc.

I've had it since my first computer... eTower 700 eMachine! I still own that and it came with Windows ME in 2000!!

Rockstar and T2 are being complete morons about this. They seem to forget that Direct Feeds and online videos are great "free" advertisements. I have never owned a console, the previews. the reviews, the hype and even the advertisements for GTA 4 didn't convince me to buy a console just to play this game. However within 24 hours of seeing all the direct feeds and gameplay, I was £200 lighter and had to have the game. So if it wasn't for all those nasty "people" out there breaching poor little Rockstars copyright they would have had one less sale.

 

I shouldn't be surprised the way T2 and Rockstar behave these days, all they care about is the bottom line profit, what they should be caring about is how they treat their fans because ultimately it is US that pay their damn bills.

that $60 is a user license fee to play the game privately in your own home. you also get to keep the plastic DVD-rom disc and packaging

 

but all the graphics/logos/artwork, etc on the sleeve, disc cover and all the content IN the disc belongs to take2/rockstar. including gameplay, characters, game code, EVERYTHING... belongs to rockstar/take2

 

you are just "allowed" to play it.

 

you are not allowed to duplicate it for any reason whatsoever
