Even if you try to not get caught by staying off XBL and EVEN if you don't even go online you WILL get banned from Xbox live. Your system saves the info of when you played it and what you played. When ever you get on Xbox live again even after the 29th expect a ban since Microsoft will see that you played the game before the 29th. No your an idiot!!! ITS A MYTH ABOUT PEOPLE GETTING BANNED!!! I HAD HALO 3 ALONG WITH SEVEN OF MY FREINDS ALMOST 2 WEEKS EARLY, WE PLAYED ONLINE ALONG WITH ALOT OF OTHERS!!! NO BAN Not really. Bungie and Rockstar aren't the same company. Rockstar obviously doesn't want people playing this early so it will most likely result in them taking action. When I connect to live it updates the data and time. I therefore have (e.g.) Oblivion save games from 2005 Do you think Microsoft may be worried that I was playing the game while it was still in the first year of development? Wow, I would be in BIG trouble then. I must have stolen the dev source code Its the retailers who will suffer if the street date is broken I had bioshock about a week before it was released and I was playing it, whilst connected to live. Unless you were given the game early as part of an agreement, because you're a reviewer or something, you are not bound by any agreement to not play GTA4 before April 29. These companies don't make laws. They can only control you if you have a contractual agreement and you don't live up to it. If someone sells you GTA4 early, THEY broke their agreement but you are free to do whatever you want. You own your copy no matter when you buy it. It is NOT the consumers responsibility to enforce street date, it is the responsibility of the retailer. Once you LEGALLY purchase the game from a store, whether they broke street date or not, you can play it all you want. You are not liable for the retailer breaking the law, thus you are doing nothing wrong playing a game you paid for. Now, if you download it from the net, that's an entirely different story. Microsoft cannot legally ban you from a service you pay for simply for playing a game. I know this because I was getting Halo 3 a week early, and there were stupid rumors about people being banned from XBL if they play it early. So I asked my uncle to look into it (he's an attorney), and no service provider (what Microsoft is with XBL) can suspend a paying customers account for using a product before it's designated release date. I got Halo 3 a week early. I finished the story before the game was even released! I'm getting GTA this Saturday, and I will play it all night long! These stupid rumors are started by people who are jealous that they cannot get the game early, so they try to sway others into not getting it. "OMG UR GONNA GET BANN'D!!!!1" Silliness. No. Once you've purchased your console it's then your property and you can do anything you want to it. Although modding your console violates Xbox Live's terms and conditions and if found to be using a modded console online your console will be banned. RoninJinn Posted April 23, 2008 Share Posted April 23, 2008 It's quite simple really... No Bans if you are playing a legitamite copy... Ban if you are playing a burned copy on a modded Xbox. And you aren't being banned because you're playing a pirated copy of GTA specifically, you're being banned because you modded your Xbox. If you look at the modding websites, they clearly state that whenever you're mod is active, DO NOT CONNECT to Xbox Live because MS will ban you. Then again, you can turn the modding off, and then connect to live, and have no problem. That's as simple as you can put it.. Legit copies won't get you banned, you may not be able to play multiplayer though, since apparently they are tracking the legit copies to reviewers to allow them access to play multiplayer. But you guys think I might get banned from Live if I'm caught playing GTA IV online? If you got the game early, I would just play Single Player missions until the game is legaly released.
