EAgames/Rockstar dosn't care if we dont make money. if it got out that people were profiting over mods, it could make the car companies and software companies very mad and crack down on us modders. i tried to report it to ebay but i couldn't find exactly how to do it. damn ebay making things confusing. i sent the guy a message though telling him why he should take them down. proabbyl wont do it though. He is doing none of us any favors. (even if R* doesn't mind us moddin their game for no profit!) I'm not going to register with ebay... but if some of yall might, we could post (feedback section/ebay) comments on it being illegal activity~ just a suggest. F**k it~ I just registered and put in a complaint with ebay and I just emailed the asshole~ but I recieved the message... To quote: "You will not use or permit third parties to use the Software Utilities and the Customized Game Materials created by you for any commercial purposes, including but not limited to distributing, leasing, licensing, renting, selling, or otherwise exploting, transferring or assigning the ownership of such Customized Game Materials." What he is selling are free, fan-made modifications available for download at no cost. Not only is this illegally ripping off the game's developer and publisher, Rockstar Games, but also those fans who have created the 'mods'. Use the same email if you like. I think it will be up to the makers of the mods on the CD to complain to ebay, there are laws against the selling of intellectual and artistic property. I think where you'd have to go is here to report the illegal activity. I don't think eBay wants this kind of dirty doings on it's hands, so I don't see why they shouldn't shut this guy (or girl) down. The guy is selling f*cken SA mods on ebay, he wouldn't seem the type to note and respect a short readme note, or even open the readme in the first place But damn, wtf. Making such an account is actually illegal to do on eBay and you can get your general IP range banned from their services, including banned from the ability to even bid on auctions. eBay has a firm stand on the issue of selling media on cd's through their auctions. If the material can be found in a store or website where you have to pay for the software or media, then it's against their rules to run auctions with such material. However, if the cd is a backup of software that has no monetary value, whether the auctioner is the creator or not, is NOT against their rules. You can run an auction, selling any software, whether you made it or not, without eBay closing your auctions because they're not selling the software itself. They're only selling the CD it comes on, for backup purposes. Yes, the issue is rather frustrating to people who may have spent days or even weeks working on a car modeling it. And I'm sure that it frustrates them to no end. But it would be rather fruitless to try to get eBay to close an auction down, or ban the person doing the auctions, when they are not going against their rules. In the US and many countries, its legal to sell backup discs of software, as long as said software is not copyrighted material sold in stores. Any lawyer would tell you straight up that you would get nothing by trying to sue this person, so threatening whoever this seller is, is also pointless. Also, they are free downloads on the net, which means anyone can download them and then redistribute them on sites or other means. I'm sure that all the modelers would prefer their work be downloaded by the respected GTA sites that have databases of mods that were submitted by the authors, but the world isn't always nice. He's not even a thief, he's in marketing, marketing to uninformed people. There is a worst kind of scum. He has Ganjica's mustang on there according to someone, I didn't check the picture. Ganj don't allow for people reusing or especially reSELLING his sh*t. That's your start point right there. Throw in the very very valid points about nonprofit and EULA and this guy is dead in the water, and stinking to high heaven. I tried to get ebay to reissue me my acct details there but nothing is arriving in my inbox yet. Anyone else with an ebay acct should link back here in that auction if they are able to post there in the meantime, it would be the best way to blow this crap apart. Edit: Vice Planet - this does not mean f*ck the flow of comms up with "stop dat lolz!!!!!!!!!" type statements, using a dodgy ebay account to draw attention to the problem doesn't necessarily draw the right kind of attention, or sympathy, or really anything but a headache. If you have an ebay account, you can leave negative feedback, which will lower his rating. But do it fast, the more people who leave feedback, the less your opinions are worth.
