Well if you're not going to be charging any money for said game, I think you can use it.

Isn't it easier to just commission a brand spanking new OST? Let me examplify using myself: I was asked if I could make music for a game called "Texture". We're still negotiating the contract, BUT! I've already made most of the music, and the developer got it EXACTLY like he wanted, by providing 'input'...
The bottom line is, ask for OST, get OST. You can have your hand in the cookie jar as well as saving some dough

I think after 50 years songs are in the public domain.
I read it was 75 years after the original artist's death

That may be the case then, I was only guessing at the figure, just knowing that it was greater than 30 years
