I returned my copy to gamestop because my 360 red ringed, they gave me my money back however I forgot to put disc 2 in the case, it's sitting here at home and a friend fixed the red ring, I have disc one already installed so I basically have the game for free.  Should I return it?  They didn't even check the case for any disc.

Well, the fact that it doesn't sound like your XBox red-ringed...you're lying. So if you did steal from Gamestop, you should return it. They will sell that to someone else that will notice. They have your name. They will find you.

Yes, its an honest mistake and imagine the person who dishes out $60 and the play disc isn't in it. Its just wrong. Correct your mistake (even though they should have checked it, my old job I always checked returns. Eff that) they will understand it wasn't on purpose.

Screw Gamestop, they rip people off everyday. I once bought a used game without a manual there for 20 bucks only to find out days later that they had new copies of the very game for 20 bucks.

Technically it's the employees fault who did not open the case. He accepted a  "video game" without verifying the content was there. He should not have issued you a refund. It was an honest mistake on your part, but the employee should have physically checked to assure the disk was there, he did not, case closed. Imagine if you tried to return TV packaging (with no TV inside the box) at a retail store and they just accept it, that would be very dumb of them to not ensure everything original is there. Bottom line it is up to the workers to check that the merchandise is there. I've worked in retail before. This is common sense. All in all, because there is such a large volume of sales occurring, it might not be too noticeable, errors happen and its the employees fault anyway. 

 

You didn't rip them off, they didn't do their job.

Police will only get involved if they call them. It's not your flat at all they didn't do there job. If the police or GameStop call you just say ok you thought you gave them it and turned it in,
