Does anyone here have any knowledge on music law?


I'm currently recording a song and i want to include an audio sample, but i'm not sure of the legal implications.

I'm no expert, but I'm pretty sure if it's a small sample (and you don't sell it) you could claim Fair Use. Isn't that what Girl Talk does?


But if you sell it, it would be a copyright issue for sure, and you would likely be sued.


Again, I'm not a legal expert.

Depends entirely on the sample and who owns it.


If you don't intend to sell your song (inc. the sample), you are fine to use it. However, the copyright holder may request that you remove the sample or cease distribution.

If it's under, like, Creative Commons, use of the sample is fine for non-commercial use.

If you do intend to sell the song, you will almost always require sample clearance.
