So after losing my 9 fps I've just finished some more testing and have made some improvements.

Ist thing I did was lauch it without the securom check, this made a minor improvement from 43.23 to 44.91 almost a 2fps improvement.

Without Securom
Statistics
Average FPS: 44.91
Duration: 37.50 sec
CPU Usage: 69%
System memory usage: 51%
Video memory usage: 92%

Graphics Settings
Video Mode: 1920 x 1200 (60 Hz)
Texture Quality: High
Render Quality: High
View Distance: 32
Detail Distance: 51

Hardware
Microsoft« Windows Vista" Ultimate
Service Pack 1
Video Adapter: ATI Radeon HD 4870 X2
Video Driver version: 7.14.10.630
Audio Adapter: Speakers (2- [email protected] Audio)
Intel® Core™2 Quad CPU Q8200 @ 2.33GHz

So then I put the settings up higher, which common sense would suggest would bring the fps down, but it improved more smile.gif I upped the render quality to very high, put detail to 100 and view distance upped to 34 from 32. I gained a 4fps improvement over my initial result. Still not near the 52 fps I had prior the patch.
