Going to court tomorrow

I know this is my second topic today, but i need some advice. A few months ago i exited the movies with my boyfriend around 12am, In my country, my city is the most unsafe out of them all. As we left, he got jumped by 2 black guys and beaten up and robbed, yeah sounds funny but it wasn't it was kinda heartbreaking to see my boyfriend lying on the ground getting kicked in the head. Anyways, my point is, the court was scheduled for October but as soon as we got in the courtroom, they told us to go home cause there were too many cases that day, its now December and its tomorrow (well, today since its 12.17am) and when i walked into the courtroom that day, i realised i had no f*cking idea what to do, i'm only 16 and haven't been to court before and im going in as a witness, no doubt the lawyers of the offender will try to prove im wrong or whatever, i'm just wanting some advice any of you may have as being a witness and what i should/shouldn't do. Cause i want this bastard to pay for what he did. He's done it before, so youd think we'll win easilly but he might get away with saying hes had a troubled life or whatever so shouldn't be punished. Which is bullsh*t cause so have i but i dont go around beating people up.

So yeah, any advice is appreciated cause this is our one shot of winning against him. Also if you have no advice, feel free to share any stories you have, if you've been in the same position, or been involved in a crime or been to court etc. All welcome

Well, I've only been to court before once, which was for underage smoking/minor in possession of tobacco and marijuana, so I'd have no idea what to do in your situation.
I tried to find a few websites about being a witness to things like this, but all I found was This.
You have no physical evidence against them, so it's your word against theirs. You have to make your story sound as real, and as connected as possible, make sure you don't say something like they kicked him in the head, but then they were on top of him punching him the next time you refer to that.
That's about all I know about it, sorry I couldn't be any more help.

I've only been to courts during excursions for school.

I would try to be as calm as possible. The way Australian and New Zealand courts work is the lawyers for each side ask the questions in a yes or no fashion, you never see people get asked to recount what they saw or go on a dramatic recall.

Just be calm and truthful, and if what you're saying is correct, this dude should fry.

Haha underage smoking eh, we don't get in trouble for that here, it's illegal to buy them, but if we're caught smoking they can't do anything but tell you not to.

I don't smoke, but used to and they couldn't do anything about it


@Jayzamann: I don't have to say what happened? Thats wierd they told me i would, but if i don't have to then i guess that takes a weight off my sholders icon14.gif

Just so you know, court is NOTHING like you see on TV. It's all very boring and rather un-eventful.

It's also pretty straight forward. There will be plenty of people there to help you out with what you're supposed to do.

It was months ago, there is none of that now lol

I stopped them before it got bad enough for him to be hospitalised, he was just really sore for a while. He's a big boy he was fine smile.gif icon14.gif I was still heartbroken though, hes such a nice guy and didn't deserve that. I wish the dickf*ck would plead guilty. He's had previous convictions, he's black (i know its racist but he's trying to win against a nice white boy and his girlfriend), black people and robberies in Auckland (my city) are just normal. So his chances of winning against us are low, i hope.

Cry a lot, and people will feel sorry for you. But if they ask you what happened, make sure you tell the truth and all the truth, and what you've seen him do before.

i don't know the guy, never seen him before that. He's a scary looking guy, always looks angry. Gave us the death stare while we waited outside the room. It was like, a building in south Auckland (the scum of New Zealand), with hundreds of black people, and like 4 white people standing there nervous. Scary stuff man. It was really uncomfortable. The main thing is to get your story totally straight before you go in, as the defense lawyers will obviously try to twist the facts to their own ends. Try to think what angle they will put on the events. I dont want to make you nervous but be prepared as they can be right f*ckers.

Try not to act nervous- shaking, fidgeting, stuttering when talking, gulping etc. And try to look at the person who is talking to you in the eye, to show you are telling the truth.

If you act nervous and start stuttering, the judge may have concerns you're not telling the whole truth.

The cuts and bruises might have been useful as forensic evidence. Perhaps, the CSI guys would have nailed the culprit on that basis.

He didnt have any cuts, the guy unfortunately hurt him in ways that didn't leave any cuts or bruises. Come to think of it, Mike, my Bf, never has bruises or anything. Maybe hes immune haha smile.gif When he comes on here tomorrow, maybe he'l have his side of the story (he's a gtaf member)

@Flicko: Yeah i'm gonna try my hardest, but nerves will come naturally and i'll be scared and all that. Hopefully ill be good at hiding it.

Anyone have any tips of how to calm nerves etc?

Just try not to think too much about the situation at hand, do your bit, don't lie and hope it all goes smooth.

On a more serious note, don't try to think of that night. The more you do ,the more nervous you'll be. Just relax, take a deep breath and answer all questions asked to you confidently. Don't show any signs of nervousness even if you are. You'll need to become an actor for one day I guess.

@topic: I've been to court far too many times, and it's not that bad, it just takes FOREVER. If the kid's guilty, he'll most likely get his, so yeah just tell 'em what went down. You'll be alright. biggrin.gif

i have not been to court before but nearly cause this guy pushed one of my mates over and he wackd his head on a nail and got concused so me and two of my mates beat up the guy that did it it may sound like a gang bash but this c*nt was big bigger then us yeah so the main resson that we nearly had to go to court is that my mate hayden was hiting the guy with a gutter board and yeah that was bad
