I'm making a website and am looking for free *legal* templates to use. I found some on google but I'm not sure if these are free to use.

Back in the day, I used free templates from Free Layouts. Some are good, although most use outdated technology (HTML).

I had a look around Open Source Web Design recently, and most seem good, using modern technologies.

Here are some legal downloads for some I found:
66,551 kb High Quality Photoshop Templates
7526 kb 306 Fast Loading Quality Templates

They're legal to use, these are the kind people have reselling rights to give away free, or sell on places like eBay.

Why anyone would use one, I have no idea. I think you're much better off having a unique design to identify your site to others.

Either way, those downloads should work and I have no idea if it's what you're looking for, but yes, they do classify under the "free site templates" category.

Maybe a bit of a daft question, but how do you use themes you downloaded/made?

If it isn't for a software package (Xoops, PHPNuke, PHPBB, IPB, etc), then you simply open it up like a normal HTML file, and edit.

If it is for a software package, I suggest reading the documentation.

I've just thought of way too, making an image template with a good graphics program, such as photoshop, and then making that the background image, then following the designed places for certain things.. that's what I've done on my website which I'm slowly setting up. - Luke.

Clan Templates. They're of course designed for gaming clans, but no one's going to stop you editing the banners and such. There are a few really good looking ones.

Zymic.com is the place I go to get free website layouts. Its got a ton.
